    This calculator is provided to ophthalmologist for convenience purposes only, in conjunction with the labeling for proming® intraocular lens, not a substitute for appropriate medical education and training or for the exercise of independent medical judgment. Eyebright cannot warrant the accuracy or completeness of information that this calculator provides. Each medical situation should be considered unique to each patient, and all treatments individualized accordingly. Eyebright expressly disclaims all liability to any person in respect of all matters and all actions taken or not taken based on any information contained herein.

1.Owership

    This calculator is owned by Eyebright and protected by the copyright law of the People's Republic of China. Eyebright owns and retains the related ownership and interests of the calculator, including the patent, trademark, copyright, trade secrets and other intellectual property rights. Therefore, the Licensee shall not use, copy or distribute this calculator without the prior written authorization of Eyebright.。  

2.User license

    This License Agreement gives the licensee the right to access the Calculator and to use it for the limited purpose of performing calculations to help determine the recommended Proming® intraocular lens and eye axis position of intraocular lens. These rights are not transferable or substituted for the purpose of making the calculator exempt from unauthorized use, modification, copying, distribution and publication. In the use of the Calculator, the licensee may input patient data according to the People's Republic of China privacy law, such data at any time will not be contact, use or retain of Eyebright.

3.Restrictive items

    The Licensee shall not lease, license or lend this Calculator. The Licensee shall not reverse engineer, decompile or disassemble the Calculator except that the restrictions are expressly prohibited by applicable law. The Licensee shall not make an error correction to the Calculator or otherwise adapt or modify the Calculator or create derivative works based on the Calculator.

4.No warranties

    This Calculator does not provide any warranty. The reference information provided by this Calculator is for the convenience of the licensee only, and shall not be used for final diagnosis or as an alternative to the Licensee's medical expertise. Although efforts have been made to make the information provided by this Calculator useful and accurate, Eyebright does not guarantee the accuracy of the information obtained from the Calculator. The Licensee shall bear all the risks and responsibilities of the use of the Calculator to achieve its intended results and any results obtained from the Calculator. Eyebright does not guarantee that there will be no errors or interruptions or failures.

    In the maximum extent permitted by applicable law, Eyebright expressly disclaim the Calculator representations and warranties express or implied, including but not limited to the Calculator of merchantability, fitness for a particular purpose, non-infringement implied warranty.

    Eyebright expressly disclaims any warranty, either express or implied, regarding the Calculator availability, accessibility, or performance. by accepting these terms, licensee hereby acknowledges that, at any given time, the Calculator may not be available or may become unavailable due to one or more of the following: periodic system maintenance, technical failure of the calculator, telecommunications infrastructure, or delay or disruption attributable to viruses, denial of service, increased or fluctuating demand, acts or omissions of third parties, or any other cause reasonably beyond the control of Eyebright.

5.Limitations on liability

    The Licensee shall bear all the costs of any damages resulting from the use of the information contained in the Calculator and the information contained herein. The maximum extent permitted by applicable law, Eyebright in no circumstances shall be borne by the use of or inability to use the Calculator any damage caused by the damages (including but not limited to direct, indirect, special, punitive, consequential or incidental damages), even though Eyebright has been told of the possibility of compensation for damage.

6.Additional provisions

    The implementation and interpretation of this License Agreement shall be governed by the relevant laws of the People's Republic of China. This Agreement shall not be subject to any person's declaration. If the licensee reads this Agreement and agrees to the terms and conditions of the Agreement, the Licensee shall be subject to the terms and conditions of this Agreement by clicking on the “accept” button below. In the event of a breach of the terms and conditions of this Agreement, the licensee may terminate this Agreement at any time. Any waiver of any of the terms and conditions of this Agreement shall not be construed as a continuing waiver of such rights by Eyebright.

    If any part of this Agreement contravene applicable laws or regulations, or be prohibited by or in accordance with applicable laws or regulations is invalid or unenforceable, such provision shall not apply, and shall be deemed to be deleted in the range of conflict, is prohibited, invalid or unenforceable the implementation of this Agreement, but the rest will not fail, and it should be possible to remain in force.
